Products purchased on mymagicdress.com are sold directly by MyMagicDress Ltd, whose registered office is at Arsenal - Royal Road -Mauritius, BRN No. C15131097, Cap. Soc. 100 000 MUR fully paid. 1. Our Commercial Policy

The supplier makes the sale of products and mymagicdress.com practice its own e-commerce activity exclusively towards end users who are final consumers.

1.2
By "consumer (s) Final (ux)" we mean any individual who works for purposes unrelated to any business or professional activity eventually performed. If you are not a "final consumer", we invite you to refrain from entering into business transactions mymagicdress.com.

Given the trade policy described above, the supplier reserves the right not to respond to orders from anyone who is not a "final consumer" or non-compliant orders to its commercial policy as defined herein.

2. How to conclude a contract with supplier

To conclude the purchase contract of one or more products on mymagicdress.com, you must complete the electronic form order form and send it to the supplier, by telematics, by following the instructions provided.

The order form contains a summary of the "Terms and Conditions", information on the essential features of each product ordered and the price that refers to (including applicable taxes or duties), the means of payment you can use to buy each product and the terms and delivery of purchased products, shipping and delivery costs, the conditions for the exercise of your right of withdrawal and the modalities and deadlines for return of purchased products.

The contract is deemed concluded when the supplier receives, via computer, your order form, once verified the accuracy of the control data.

Prior to the purchase of products by transmitting the order form, you are asked to carefully read these Terms and Conditions, print a copy using the "print" and to maintain or reproduce a copy for personal use.

The order form will be filed in our database for the time strictly necessary for the processing and shipping of orders in accordance with applicable legal deadlines. You can access your order form by visiting the My command.

Before submitting the order form, it is also asked you to detect and correct any data entry errors.

Transmission of orders to the supplier must be conducted in French or English.

After submitting the order form, the provider will process your order. It is recalled here that any transmission of an order form carries liability of products to the final consumer.

2.9
In cases where products, presented on mymagicdress.com, would no longer be available or on sale at the time of your last access to the site or sending the order form, the supplier will have to inform you, as soon the transmission of your order to the supplier, the possible unavailability of products ordered.
In case of transfer of the control and payment of the price form, the supplier will arrange to repay the amount you have already advanced at the latest within 14 days of your payment.

By transmitting via telematics the order form, you accept unconditionally and you undertake to respect in the relations with the supplier, these Conditions of Sale. If you disagree with some terms indicated in these Conditions of Sale, please do not submit your order form for the purchase of products on mymagicdress.com.

By submitting your order form, you confirm awareness and acceptance of these General Terms and Conditions and any subsequent information in mymagicdress.com (also viewable through hypertext links) and these terms and conditions and the Privacy Policy .

After you submit an order, the supplier will send you by e-mail, your order receipt, containing a summary of information already contained in the order form (General Conditions of Sale, information on the essential characteristics of the product, detailed indication of the price, payment methods, the existence of your right of withdrawal and the time and cost of delivery).


3. Product price guarantee and indication

On mymagicdress.com, we offer only branded articles Resorts AR / Aima Dora / Vguardia accessories. We buy these items directly from the manufacturer / brand owner and / or licensed manufacturer of the latter.

3.2
The vendor does not sell used products, defective or substandard market.

3.3
The essential characteristics of the products are presented on mymagicdress.com within each of the product sheets. The images and colors of products sold on mymagicdress.com may not exactly match the actual colors under the effect of the Internet browser and the screen used.

3.4
Product prices may be subject to updates. Thank you kindly check the final price of sale before sending the order form.

3.5
Purchase requests from countries not included among those displayed in the home page may not be accepted by the supplier.

3.6
All products are provided with an identification tag attached with a single-use sealed. Thank you not to remove the label and single-use products purchased sealed.

3.7
The supplier, in case of exercise of your right of withdrawal, has the right to not accept the return of products that are free of the label or have been altered from their original or qualitative characteristics or that were damaged.


4. Payments
4.1
For payment product prices and costs associated with shipping and delivery, you can follow the procedures indicated on the order form.

4.2

6. Right of withdrawal
6.1
You have the right to terminate the contract with the supplier without penalty and without specifying the reason, within seven days (14 days) from the day of receipt of the products purchased on mymagicdress.com. It is however not possible to change the purchased item to another.

6.2
To exercise your right of withdrawal, please fill out the return form.

6.3
In this case, you must restore essential products to the supplier by giving them either the DHL courier whose phone number is in the Right of withdrawal section or by a carrier of your choice within a maximum period of seven days (14 days) from the date you have exercised your right of withdrawal.
The only cost to you is the direct cost of returning the purchased products.

6.4
If you decide to use the carrier indicated by the supplier in the Return Form, the supplier will advance your account for the cost of returning directly from the carrier. Then, for the costs of return that you pay, the supplier will deduct the refund due to you a lump sum equal to the shipping and delivery charges originally paid for products purchased and subject to withdrawal. In addition, upon delivery of purchased products to the carrier indicated by the supplier in the form back, the supplier puts you out of any liability for loss or damage to goods during transportation.

6.5
If you decide to use a different carrier from that indicated by the Seller in the Return Form, you will personally make the payment the cost of return, at your expense, the products purchased. In this case, the refund due to you will be subject to any deduction. This refund will include, in addition to the price of products purchased, the delivery costs originally paid for the products purchased. Any liability for loss or damage to goods during return transport will remain your responsibility.

6.6
In addition to observing the terms and procedures described in Sections 6.1, 6.2 and 6.3, the return of goods in case of exercising the right of withdrawal, is considered done correctly if the following conditions are fully met:

the return form is properly completed and sent to the supplier;
the product must not have been worn or worn, altered or washed nor damaged;

6.7
If the right of withdrawal is exercised in accordance with the procedures and terms indicated in this article 7, the supplier will arrange for repayment under the conditions specified in section 7.2 below within a maximum of fourteen (14) days from the delivery of goods to the carrier or DHL, in case of choice of another carrier, from the receipt by the supplier of the evidence of shipping products. And, if you choose to use the DHL carrier indicated in Right of withdrawal section, the cost of returning your dependents will be deducted from the amount refunded as specified in section 7.2 below.

6.8
In accordance with Article 8 below, the funds will be refunded as soon as possible and in any event within fourteen (14) days of delivery of the goods to the carrier or DHL, when choosing a another carrier, from the receipt by the supplier of the proof of the shipment of products, subject to the proper execution of the terms and conditions listed above. And, if you choose to use the DHL carrier indicated in Right of withdrawal section, the cost of returning your dependents will be deducted from the amount refunded as specified in section 7.2 below.

6.9
In the event that the terms and the terms for exercising the right to withdrawal specified in Article 7, have not been respected, you will not be entitled to reimbursement of amounts already paid to the provider and any associated fees product return will be your responsibility. However, if you ask you can get back at your expense, the products in the state in which they were returned to the supplier. Failing such a request, the supplier will keep the products in addition to sums already paid for their acquisition.


7. Time limits and repayment terms
7.1
After the return of the products, the supplier shall undertake the checks of compliance with the terms of withdrawal and return as specified in Article 7. If the above lead to the fulfillment of those conditions, the supplier shall act to send via e- mail confirmation and acceptance of returned products.

7.2
To exercise your right of withdrawal, please fill out the return form.

7.3
In case there would be no correspondence between the recipient of the products indicated in the order form and the one who made the payment of amounts due for the purchase, and in case of exercise of the right of withdrawal, reimbursement the amount as specified in section 7.2 above will be carried out by the supplier, in all cases, to the person who made the payment.

7.4
For purchases by credit / debit card, the date of the new credit will be the same as the flow, with the result that you will not be penalized (e) in relation to your bank interest.

7.5
The supplier shall indicate in the section Right of withdrawal DHL carrier that can be used to return the products. This return will be your responsibility. Via UPS, using the pre-printed adhesive label attached to the package containing the products, you can return the products to the supplier directly ahead from the carrier, for your account, the costs of returning products purchased, putting yourself out any obligation to direct payment to the carrier subject to a subsequent repayment to the Seller. This method also allows you to check at any time where each package is located, putting you out any liability for loss or damage to goods during transportation.

7.6
If you decide to use, for the return of products, a different carrier DHL indicated by the supplier, you will personally make the payment of the cost of returning any liability for loss or damage to goods during transportation remains fully your dependent under the terms and conditions provided for by the exercise of the Right of Withdrawal.

Subject to the provisions of Public Order of the Mauritian law, the "Terms and Conditions" and the contract of sale are governed by the Mauritius Act in respect of distance contracts and on all aspects of e-commerce.
